These regulations have been framed in response to various complaints made against spam calls and SMSs. Therefore, any sort of unsolicited commercial communication pertaining to gambling or betting will attract the prohibition contained in these Regulations. The government has used this power to instruct Internet Service Providers to prevent Indian residents from accessing certain foreign betting and gaming sites, but we don’t know for sure how effective this has been or which sites have been blocked. The bench clarified that all proceedings pending before these high courts regarding aviator signal challenges to the new law will now be heard only by the Supreme Court, and the high courts will no longer entertain related petitions. Even in the judgment of R v Kelly,29 the UK’s Court of Appeal had held that the jury in the Trial Court was entitled to hold that Texas Hold’em Poker was a game of chance as defined under the Gaming Act, 1968.  Rummy, which has been held to be a game of skill in the Satyanarayana Case, was distinguished on the ground that it had nothing to do with stakes. Accordingly, even if it was a game of skill, if it was played with stakes, it would amount to gambling. The Respondents also relied upon the Chamarbaugwala Case, in which the SC had held that the provisions under the Prize Competitions Act, 1955, are severable in their application to only games of chance. O a person had to assess rival players’ reaction whilst maintain a ‘poker face,’ i.e. keeping one’s expression concealed;o Every turn of the card required a player to assess whether to continue or not. The exercise of judgment was recognized to be an exercise of skill in the Lakshmanan Case.o A player must possess intellectual and psychological skills.

Understanding Online Gaming Guidelines in India

• The SC also mentioned that the observations in the Impugned order may not necessarily relate to online rummy.
• However, it is important to note that “lotteries” are expressly excluded from this ambit, as they are listed under Entry 45, List I3 (the Union List), thereby falling within the legislative competence of the Central Government.
• Sikkim Online Gaming (Regulation) Act 2008 (“Sikkim Gambling Law”) was passed on June 28, 2008 with the dual objects of controlling and regulating online gaming through electronic or non-electronic formats, and imposing a tax on such games in the State of Sikkim.

In order to offer online sports betting, a gambling license is required to be obtained from the Government of Sikkim under the provisions of the Sikkim State laws. The judge also rejected the reliance placed by the Petitioners on foreign articles and judgments. He held that the hypotheses in these articles could not take a game out of the purview of the Gujarat Act. In the appeal it had been clearly observed that the parties did not dispute that Poker constituted gambling under New York State law.

The court decided to rely on the Apex Court’s decision inState of Andhra Pradesh v. K. Satyanarayana6 and Dr. K. R. Lakshmanan v. State of Tamil Nadu & Anr.7, that Rummy even though both a game of chance and skill is predominantly a game of skill. Skill games have been defined by the Supreme Court as “ the competitions where success depends on substantial degree of skill or not gambling and despite there being an element of chance of a game is preponderantly a game of skill it would nevertheless be a game of mere skill” . Therefore, Horse racing or dog racing has been declared to include substantial amounts of skill and therefore these do not fall under the definition of gambling except under certain situations/conditions. Interestingly, the game of rummy was declared a game of skill by the Supreme Court. The reasoning given by the Supreme Court was that “ rummy requires a certain amount of skill since the fall of cards has to be memorized and the building up of rummy requires considerable skill in holding and discarding cards.

B. Sikkim

Goa and Sikkim were the only states that allowed gambling and betting, subject to regulations made by these respective states. Other states have also formulated their own legislations in order to regulate and govern the gambling activities on their territory. The majority of gambling laws were enacted before the advent of virtual or online gambling and betting.
